Terms & Conditions

These Terms & Conditions govern your use of Moments, operated by Gabriele Sinis ("we", "us", "our"), accessible at momentsphotos.co.uk. By creating an account or using our service, you agree to these terms.
1. The service
Moments provides a private, web-based photo sharing platform for events. Upon payment, you receive access to a unique event app that allows your guests to upload photos, complete photo missions, and view a shared gallery. The service includes admin tools for moderating content and downloading photos.
2. Eligibility
You must be at least 18 years old to create an account and purchase our service. By using Moments you confirm that you meet this requirement.
3. Payments and pricing
- All prices are listed in GBP and are one-time payments per event
- Payments are processed securely by Stripe
- Your purchase gives you access to one event app for the duration specified
- Prices may change - any changes will not affect purchases already made
- Early access pricing is offered at our discretion and may be withdrawn at any time
4. Refund policy
Moments provides a digital service that is made available to you immediately upon payment. By completing your purchase and accessing your event app, you acknowledge that the service has been provided and you agree to waive your 14-day right to cancel under the Consumer Contracts Regulations 2013.
Technical issues
If you experience a technical problem that prevents the service from functioning as described, please contact us at hello@momentsphotos.co.uk as soon as possible. We will make every effort to resolve the issue promptly. If we are unable to resolve a genuine technical fault within a reasonable timeframe, you may be entitled to a full or partial refund at our discretion, in line with your statutory rights under UK consumer law.
Unused albums
If you have paid for an album but have not yet used the service (i.e. your event URL has not been accessed by any guests), please contact us at hello@momentsphotos.co.uk with the reason for your request. We will review each request individually and respond within 5 working days. We do not guarantee refunds in this case but will consider each request fairly.
Used albums
Once your album has been accessed by guests and photos have been uploaded, we do not offer refunds as the service has been delivered. However, if you are unhappy with your experience for reasons beyond technical failure, please reach out to us and we will consider your situation on a goodwill basis.
How to request a refund
All refund requests must be submitted by email to hello@momentsphotos.co.uk with your order details and the reason for your request. We aim to respond within 5 working days. Approved refunds will be processed via the original payment method through Stripe.
5. Your event app
- Your event app is active from the date of purchase
- Guest access to the album remains available for 30 days after your event date
- After 30 days, the album may become read-only or be archived
- You are responsible for downloading your photos before the album expires
- We are not liable for photos lost due to failure to download before expiry
6. Acceptable use
You agree not to use Moments to:
- Upload illegal, offensive, defamatory, or inappropriate content
- Upload photos of individuals without their consent
- Attempt to gain unauthorised access to our systems
- Use the service for any commercial purpose other than your own event
- Resell or sublicense the service to others
We reserve the right to suspend or terminate accounts that violate these terms without notice or refund.
7. Content and photos
You and your guests retain ownership of all photos uploaded to your event app. By uploading photos, you grant us a limited licence to store and display them within your event app for the purpose of providing the service.
We do not use your photos for any marketing, training, or commercial purposes without your explicit consent.
You are responsible for ensuring that photos uploaded by your guests comply with applicable laws, including copyright and data protection laws.
8. Availability and uptime
We aim to keep Moments available at all times but cannot guarantee uninterrupted access. We use reliable third-party infrastructure (Netlify, Supabase, Cloudinary) but are not responsible for outages caused by these providers.
We will make reasonable efforts to notify you of planned maintenance that may affect your event, and will avoid scheduled maintenance during peak wedding season (April to October).
9. Limitation of liability
To the fullest extent permitted by UK law, we are not liable for:
- Loss of photos due to technical failures beyond our control
- Indirect or consequential losses arising from use of the service
- Content uploaded by your guests
- Any disruption to the service caused by third-party providers
Our total liability to you shall not exceed the amount you paid for the service.
10. Privacy
Your use of Moments is also governed by our Privacy Policy, which is incorporated into these terms by reference.
11. Changes to the service
We may update or improve the features of Moments at any time. We will not remove core functionality that you have paid for without reasonable notice and an appropriate remedy.
12. Changes to these terms
We may update these Terms & Conditions from time to time. We will notify you of significant changes by email. Continued use of the service after changes constitutes acceptance of the new terms.
13. Governing law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
